Payment Terms & Conditions

In addition to the terms & conditions which govern the use of the Marks Hall website, any purchase of products by You from this website is also governed by these additional Purchase Terms.

In these Purchase Terms:

The Seller means the Marks Hall Estate (registered charity no 256700) Marks Hall Road, Coggeshall, Essex CO6 1TG

Us means Marks Hall either alone or together with You, as the context requires

You means the person ordering goods subject to these Purchase Terms

1. Agreement

a) The Marks Hall Estate cannot accept your order until You have paid for it in full. You may pay by credit or debit card.
b) Upon payment the Marks Hall Estate will confirm receipt of your order by acknowledgement displayed onscreen once your payment details have been accepted, followed by an email which will be sent to the email address You provide on your order details.
c) You will have an opportunity to check and correct your order up until the point at which You submit your order by clicking the confirm order button at the checkout.
d) Your order represents an offer to Us to purchase goods which is accepted by Us when we send you an email confirming acceptance of your order. A legally binding contract between Us is created at the point of our acceptance of your order.
e) The Marks Hall Estate reserves the right to choose not to accept your order for any reason, at its discretion, and will not be liable by You or anyone else in those circumstances.
f) The supply of goods is subject to availability.

2. Prices and Payment

a) The prices for goods and services displayed for sale on this website are set out on the website. All prices are in pounds (£) sterling, inclusive of VAT.
b) Prices may change at any time prior to (but not after) acceptance of your order.
c) In the unlikely event that the price of goods or services have been incorrectly
advertised on this website we will contact You by email, or telephone You, to ask whether You wish to proceed with the order at the correct price. If You are not happy to proceed or we are unable to obtain your instructions, we will cancel the order and provide You with a full refund of any monies debited.
d) By using a credit/debit card to pay for your order, You confirm that the card being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform You of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

3. Delivery

a) Subject to availability the Marks Hall Estate will endeavour to deliver the goods You have ordered within 5 working days of You placing the order. We cannot
accept liability for late deliveries which are due to circumstances outside of our reasonable control. We will deliver the goods direct to the address specified by You when You submit your order.
b) Deliveries are made Monday to Friday (excluding bank and public holidays), normally between the hours of 9.00am and 5.00pm. The precise timing of the delivery cannot be specified.
c) If your order consists of more than one item those items may be delivered separately, but we cannot deliver items within the same order to multiple addresses.
d) Deliveries will be made to your door or the specified location identified by You on submitting your order. The Marks Hall Estate is not responsible for any additional carrying or positioning of goods.
e) Once delivered the goods will become your property (provided they have been paid for in full) and your responsibility. The Marks Hall Estate will not accept any liability for their loss, damage or destruction after they have been delivered. Certain deliveries must be signed for.
f) If the goods you ordered are not available for whatever reason, The Marks Hall Estate will inform you of the position by email or telephone. If the goods are temporarily out of stock we will ask if You wish to wait for the goods to become available. Unless You advise us of your wish to do so, the Marks Hall Estate will refund any money debited from your payment card by re-crediting your account. The refund will be made as soon as possible and in any case within 28 days of notifying You of the non-availability of goods ordered.

4. Your right to cancel

You may cancel your order, or any part of it, at any stage before the goods are delivered to You by notifying us at the following address:

The Marks Hall Estate will refund your payment card account with any money debited from it as soon as possible after receiving notice of cancellation from You and in any case within 28 days of receipt of that notice.

5. Refund Policy

If you do not wish to keep any of your purchases from the Marks Hall Estate, you may return them to us within 7 days, in an unused condition, in their original packaging and we will provide a refund. In such cases where there is no damage or defect to the goods we are not able to refund the postage or delivery costs. If the goods are not returned to us in a resalable condition we also reserve the right to withhold a proportion of the costs.
Faulty Goods
The Marks Hall Estate only provides quality products and we hope the goods and services sold to You will meet with your approval. If however You are dissatisfied with anything that you receive from Us, for any reason, we would ask You to contact

Us immediately using the contact details set out in section 4 in order to discuss the problem.
Event Tickets
The Marks Hall Estate will only refund event tickets if the event is cancelled by us or the event promoter. We will notify You in writing or by email should the event be cancelled, The Marks Hall Estate will refund your payment card account with any money debited from it as soon as possible, and in any case within 28 days of receipt of that notice.
Tickets cannot be exchanged or replaced if lost.

6. Security

We protect your details when we process your order and do not hold any of your credit card details.
